SSCCLC WEEKLY LEGISLATIVE BILL AND HEARING REPORT – February 7, 2025

 

Wrapping up week four of the 2025 session and inching closer to the first cut off date of February 21st.  Key things to note this week include a drop in the number of newly introduced bills and the passage of bills of the floor of each of the houses.  This includes a big, controversial parental rights bill - https://www.seattletimes.com/seattle-news/politics/wa-dems-gop-clash-over-proposed-rewrite-of-parents-bill-of-rights/

 

In particular, this week we saw several concerning bills introduced and scheduled for hearing that impact business.  The first is SB 5548 which would require health care costs paid by the employer to be calculated into workers’ compensation timeloss costs.  This bill would significantly increase timeloss costs but is also concerning because it would increase the payments but would not have any assurance that the worker has health care insurance.  In addition, it sets up a tiered system of payment based on the number of family members a workers has.

 

Another is HB 1747 which would expand the existing Fair Chance Act/Ban the Box to make it more difficult for employers to get information regarding prior convictions before hiring and employee.  The bill also sets up an aggressive penalty structure and steps that would need to be taken before an “adverse employment action” could be taken.  While many employers and industries are actually participating in programs to help hire people with past arrests and convictions, this bill takes away the ability for the business to truly have the discussions about what happened in the employee’s past and how it would impact the work or business before the worker is hired.

 

We also are seeing quite a few bills to increase unemployment insurance payments – one to part time workers and another to students.  Both of these are concerning to the business community because of the impact on the fund, potential issues with federal conformity, and misuse of the unemployment insurance benefit system.  The biggest of these, SB 5041 which provides unemployment insurance benefits to striking workers.  It was expected to move out of the Senate Labor & Commerce Committee on Friday, February 7th but was not voted on.  The business community continues to oppose this bill regardless of amendments.
